Article 5 of the Immigration Control Act states that entry may be refused to persons who are likely to become a financial burden on the state or local government. For this reason, the Japanese spouse (as guarantor and supporter) must objectively prove their income and tax payment status. If you contact the Immigration Bureau, they will tell you the “minimum required documents,” but those are only the basic documents needed for acceptance. In reality, you must prepare additional materials tailored to your circumstances and carefully explain that your marriage is genuine. If your paperwork is incomplete, even a true marriage can be suspected as fraudulent, leading to denial or further investigation.

Even if a marriage is genuine, it will not be approved unless it can be objectively proven. Additionally, the credibility of the marriage may be questioned depending on the foreign spouse's past residence status. An application for a Certificate of Eligibility is submitted by the foreign national or the Japanese spouse acting as a legal representative at the Regional Immigration Services Bureau that has jurisdiction over the planned place of residence. It is common to apply through an agent, such as a certified administrative scrivener (gyoseishoshi).

在留資格認定証明書の交付申請は、外国人本人または日本人配偶者が法定代理人となって、予定居住地を管轄する地方出入国在留管理局で行います。通常は、行政書士などの代理人を通して申請する方法が一般的です。

Just because a marriage has been legally established with a foreign national living overseas does not automatically grant a marriage visa. The Immigration Bureau will first screen whether the marriage is genuine and if the Japanese spouse has the financial ability to support the living and stay expenses. Only after this review will the "Spouse or Child of a Japanese National" Certificate of Eligibility be issued.

海外に在住している外国人と婚姻が成立したからといって、自動的に結婚ビザが与えられるわけではありません。入管局では、婚姻が真正なものであるか、また日本人配偶者が生活費や滞在費を負担できる能力があるかなどを審査したうえで、はじめて「日本人の配偶者等」の在留資格認定証明書が発行されます。

You will submit your application with the necessary documents to the Regional Immigration Services Bureau. If the review determines that it is appropriate for your spouse to live in Japan, a Certificate of Eligibility will be issued. After that, you must submit this certificate to the Japanese Consulate-General in your country to obtain a visa.

Step 4: Application at the Immigration Bureau
手順④ 出入国管理局での申請

We will take the original residence card and passport of the applicant and submit the "Certificate of Eligibility Application" on your behalf at the Immigration Bureau. The applicant does not need to be present.

申請人の在留カード及びパスポートの原本をお預かりし、入国管理局に当職が出向き「在留資格認定証明書交付申請」をします。申請人の同行は不要です。

Step 5: Certificate of Eligibility Is Issued
手順⑤ 在留資格認定証明書が交付されます。

After about one month, the Certificate of Eligibility will be issued. We will then send it to you.

1か月程後、在留資格認定証明書が交付されますので、ご依頼者様に送付いたします。

Step 6: Send the Certificate of Eligibility Abroad
手順⑥ 在留資格認定証明書を外国に送付

You, the client, will send the issued Certificate of Eligibility to the applicant who is overseas. The applicant can then obtain a marriage visa at the Japanese diplomatic mission in their country.

交付されました在留資格認定証明書を、ご依頼者様が外国にいる申請人に送付し、日本の在外公館にて結婚ビザの発給を受けてください。

Step 7: Entry into Japan and Resident Registration

After the visa is issued, the applicant must enter Japan within three months and receive their residence card at a Japanese airport. After that, they should register their residency at the city hall of their place of residence.

ビザ発給後三か月以内に入国し、日本の空港で在留カードの交付を受けてください。その後、住所地市役所にて住民登録してください。

The proxy for a Certificate of Eligibility application must have an address in Japan and be staying in Japan at the time of application. If the Japanese spouse lives in Japan, they will be the legal representative.

在留資格認定証明書の交付申請は、代理人が日本に住所を持ち、申請時に日本に滞在している必要があります。日本人配偶者が日本で生活している場合は、その配偶者が法定代理人となります。

However, if the Japanese spouse also lives overseas, they cannot be the legal representative. In that case, a relative of the Japanese spouse will need to act as the legal representative to submit the application. This relative only needs to be able to prove their relationship; they do not need to show economic capacity such as income or assets.

しかし、日本人配偶者も海外に在住している場合は、法定代理人にはなれません。その場合は、日本人配偶者の親族に法定代理人になってもらい、申請を行います。法定代理人は親族関係が証明できればよく、収入や資産などの経済力を示す必要はありません。

Procedure for Changing to the "Spouse or Child of a Japanese National" Status of Residence

When a foreign national residing in Japan gets married to a Japanese citizen and wishes to engage in activities different from their current status of residence, an application for permission to change their status of residence to "Spouse or Child of a Japanese National" is required. This application can be made at any time within the period of stay, and through this procedure, the foreign national can obtain a marriage visa without having to leave Japan. We will explain the procedure and necessary documents in detail.

What to Do Before Changing to a Marriage Visa

結婚ビザに変更する前にしておくこと

Before you apply to change your status of residence to "Spouse or Child of a Japanese National," your marriage must be legally established in both spouses' countries.

「日本人の配偶者等」への在留資格変更許可申請を行う前には、まず夫婦双方の国で法律的に結婚が成立している必要があります。

If both of you reside in Japan, it's common to complete the marriage procedures in Japan first. After that, you can report the marriage to the foreign spouse's home country at their embassy or consulate in Japan. However, some countries may not accept marriage reports at their diplomatic missions in Japan. In such cases, you will need to report the marriage in your home country and obtain a marriage certificate from them.

お二人が日本在住の場合は、まず日本で結婚手続きを行うのが一般的です。その後、お相手の国への婚姻報告は、日本にある大使館・領事館で行うこともできます。ただし、国によっては日本国内の大使館・領事館では婚姻報告を受け付けてもらえない場合があります。その場合は、本国に報告し、婚姻証明書を発行してもらう必要があります。

The "Spouse or Child of a Japanese National" status of residence is granted on the premise that the couple will live together. Therefore, applications based on the premise of a separate residence are, in principle, not approved. Please complete the moving-out and moving-in procedures at your local government office to ensure that the couple is living at the same address.

「日本人の配偶者等」の在留資格は、夫婦として共に生活することを前提に与えられます。したがって、別居を前提とした申請は原則認められません。役所で転出・転入の手続きを行い、夫婦が同じ住所で生活していることを確認できるようにしてください。

If the foreign spouse was previously staying in Japan on a work visa and living separately, they might need to quit their job to start living with their spouse. In this case, you should obtain a certificate of retirement from their employer and prepare to submit it to the Immigration Services Bureau. This can serve as one piece of evidence that the couple is actually cohabiting.

また、外国人配偶者がこれまで就労ビザで日本に滞在し、遠距離で生活していた場合、同居を始めることで勤務先を退職しなければならないことがあります。その際は、退職証明書を勤務先から受け取り、出入国在留管理局へ提出できるよう準備しておきましょう。これは、夫婦が実際に同居していることを示す資料の一つとなります。

After about one month, a postcard notifying the result will be sent to us. We will again take the residence card and passport and visit the Immigration Services Bureau. Once the new residence card is issued, the procedure is complete, and we will send it to you. The applicant does not need to report to the city office unless their address has changed.

Applying for a Status of Residence Change from a Temporary Visitor Visa to a Marriage Visa

短期滞在ビザからの結婚ビザへの在留資格変更許可申請

There is a method to change a foreign spouse's status of residence to "Spouse or Child of a Japanese National" after they have entered Japan on a "Temporary Visitor Visa" and the circumstances have changed. In this case, it is essential that the marriage has been legally established in Japan. Also, the application will only be accepted if the Temporary Visitor Visa has a period of stay of "90 days." This is because visas of "15 days" or "30 days" are not eligible for the special grace period, and the Immigration Services Bureau does not have enough time for review.

外国人配偶者の日本への入国は「短期滞在ビザ」でなされて、入国後に事情が変わったことを理由に、「日本人の配偶者等」への在留資格変更する方法があります。この場合、日本での婚姻が成立していることが必須です。また、短期滞在ビザの在留期間が「90日」でないと申請は受け付けてもらえません。短期滞在ビザ「15日」や「30日」では特例期間の適用が受けられず、出入国在留管理局の審査に時間的余裕がないことが理由です。

Extending Your "Spouse or Child of a Japanese National" Status of Residence

在留資格「日本人の配偶者等」の在留期間更新について

If a foreign national is staying in Japan with the "Spouse or Child of a Japanese National" status of residence and wishes to continue living in Japan past their expiration date, they must file an "Application for Extension of Period of Stay."

在留資格「日本人の配偶者等」で日本に滞在している外国人が、在留期限を過ぎても引き続き日本に住み続けるためには 「在留期間更新許可申請」 を行う必要があります。

If this application is not submitted before the expiration date, you could become an illegal resident and, in the worst case, be subject to forced deportation.

この申請を在留期限までに行わないと、不法残留となり、最悪の場合は強制退去の対象となる可能性があるため注意が必要です。

When applying, you will typically request the same period of stay as your current one (1, 3, or 5 years), but you can also request a longer period if desired. The Immigration Services Bureau (formerly the Immigration Bureau) will review your living situation and past residency records and may grant a longer period of stay if they deem it appropriate.

Step 1: Contact Us First

Step 2: Interview for Details
手順② 面接によるヒアリング

If you decide to retain our services, we will visit you. During the meeting, we will discuss the reasons for the renewal, create a list of necessary documents, and gather information for drafting the statement of reasons.

ご依頼いただけましたら、当職がご依頼者様を訪問させて頂きます。ご面談の際に変更の理由の内容などお聞きし、必要書類のリストアップ、理由書作成のためのヒアリングをさせていただきます。

Step 3: Signature on the Application Form
手順③ 申請書へのご署名

Once the required documents have been collected and the necessary forms are completed, we will obtain signatures from both the applicant (foreign national) and the guarantor.

提出書類の収集と作成書類が完成しましたら、申請人（外国人）と身元保証人双方からご署名を頂きます。

Step 4: Application at the Immigration Services Bureau
手順④ 出入国管理局での申請

We will take the original residence card and passport of the applicant and submit the "Application for Extension of Period of Stay" on your behalf at the Immigration Services Bureau. The applicant does not need to be present.

申請人の在留カード及びパスポートの原本をお預かりし、出入国在留管理局に当職が出向き「在留期間更新許可申請」をします。申請人の同行は不要です。

Step 5: A New Residence Card Is Issued
手順⑤ 新しい在留カードが発行されます。

After about one month, a postcard notifying the result will be sent to us. We will again take the residence card and passport and visit the Immigration Services Bureau. Once the new residence card is issued, the procedure is complete, and we will send it to you. The applicant does not need to report to the city office unless their address has changed.

1か月程後、結果の通知のハガキが当職に届きます。再度在留カードとパスポートをお預かりし、入国管理局に出向きます。新しい在留カードが発行されましたら、手続きの完了となり、ご依頼者様に送付いたします。申請人は住所の変更などがなければ特に市役所での届出は必要ありません。

This section explains the procedure if you have divorced the spouse from your previous status of residence application and have since remarried another Japanese person.

前回の在留資格許可時の配偶者と離婚し、その後に別の日本人と再婚した場合について説明します。

The "Spouse or Child of a Japanese National" status is granted based on "activities as a spouse of a Japanese national," so you do not need to change the status of residence itself even if your spouse has changed. However, the renewal procedure when you have remarried a new spouse is different from a simple renewal of stay, and you will be required to submit documents similar to a status of residence change application.

在留資格「日本人の配偶者等」は、**「日本人の配偶者としての活動」**に基づいて与えられるため、相手が変わっても在留資格そのものを変更する必要はありません。ただし、新しい配偶者と再婚した場合の更新手続きは、単純な在留期間更新とは異なり、在留資格変更申請に近い資料の提出が求められます。

Specifically, you will need to prepare documents that prove:
具体的には、

• The financial basis to support the couple's life (ability to cover living expenses)
  夫婦の生活を支える経済的基盤（生活能力）

• A clear and consistent explanation of the circumstances from dating to marriage
   交際から結婚に至るまでの経緯の説明（合理的で矛盾のない内容であること）
  などを証明する資料を準備する必要があります。

A point of caution: If you were already dating your current spouse but renewed your status of residence based on your relationship with your former spouse, that application will be considered a "false application." In such a case, it is highly likely that your current renewal application will not be approved. The appropriate action would be to once return to your home country and return your residence card. After that, your new Japanese spouse should file a "Certificate of Eligibility Application" on your behalf to bring you back to Japan.

また注意すべき点として、すでに現在の配偶者と交際していたにもかかわらず、前の配偶者との関係で在留期間更新をしていた場合は、その申請が「虚偽申請」とみなされます。この場合、今回の更新申請も認められない可能性が高いでしょう。その際は、一度母国へ帰国し在留カードを返納した上で、改めて新しい日本人配偶者に 「在留資格認定証明書交付申請」 をしてもらい、日本に呼び戻してもらうのが適切な対応となります。

 ポイント

• Renewal of stay with a new spouse: You will be required to submit documents similar to a status of residence change application.

• If your renewal was approved while you were already dating your current spouse: You should return your residence card, go back to your home country, and have your current spouse apply for a Certificate of Eligibility.

• 配偶者が変わった時の在留期間更新 → 在留資格変更許可申請と同様に書類の提出が求められる。

• 今の配偶者と交際していたにもかかわらず、在留期間更新が許可された場合 → 在留カードを返納し、一旦帰国して今の配偶者に在留資格認定証明書交付申請をしてもらう。
